Title VII, ADA, SEC on Supreme Court docket
The U.S. Supreme Court is poised to issue still more rulings that will shape the role of the government and the rights of citizens in the coming term. In addition to weighing the utility of the Chevron doctrine and its role in assessing government regulation (see “Supreme Court will consider Chevron doctrine, role of ‘administrative state’” for a separate discussion of that case), among the cases affecting the workplace are those that will determine the breadth of the reach of Title VII of the Civil Rights Act of 1964, the role of “testers” under the Americans with Disabilities Act (ADA), the constitutionality of Securities and Exchange Commission (SEC) enforcement, and the burden of proof for whistleblowers under the Sarbanes-Oxley Act.
