OFCCP regulatory agenda narrowed

The Biden administration Spring Regulatory Agenda issued on June 13 reflects a less aggressive regulatory agenda for the Office of Federal Contract Compliance Programs (OFCCP). The new agenda still contains the proposal to modernize the OFCCP regulations but has moved the date for the issuance of a notice of proposed rulemaking (NPRM) from March to December 2023. Interestingly, the 2023 Spring Regulatory Agenda no longer contains the proposal that federal supply and service contractors would be required to provide notice to the OFCCP when they award subcontracts. The Office of Management and Budget (OMB) has approved the OFCCP’s proposal to revise the pre-enforcement notice and conciliation procedures that the agenda schedules to be issued in June 2023.

OFCCP issues new construction contractor CSAL

The OFCCP issued a new corporate scheduling announcement list (CSAL) for construction contractors. The CSAL lists 250 federal contractors, federally assisted contractors, and federally assisted subcontractors. The agency also published its methodology of how these contractors were selected.
