OFCCP issues new CSAL
On Friday, May 20, the Office of Federal Contract Compliance Programs (OFCCP) published a new Corporate Scheduling Announcement List (CSAL) for supply and service contractors, which is comprised of 400 federal contractors and subontractors (https://bit.ly/3Pyhly5). The CSAL is a courtesy notification to contractors selected for a Compliance Review (Establishment Review), Corporate Management Compliance Evaluation, or Functional Affirmative Action Program Review. The review will start once the contractor receives the OFCCP’s Office of Management and Budget’s approved scheduling letter, which is a change from the prior administration’s provision of providing contractors 45 days before issuing scheduling letters.
The CSAL had been initially posted on the OFCCP’s website on Thursday morning but was quickly removed. That list is the same as the one officially posted.
Yang, OFCCP attempt to clarify obligations of Directive 2022-01
Contractors have raised many issues about the OFCCP’s new directives, especially Directive 2022-01. In recent discussions with contractors, Director Jenny Yang and Beverly Dankowitz, Associate Solicitor for U.S. Department of Labor’s (DOL) Civil Rights and Labor-Management division, attempted to clarify what contractors are obligated to do to comply with the directive and when pay equity audits can be protected by attorney-client privilege.
