OFCCP director speaks to Institute for Workplace Equality
Office of Federal Contract Compliance Programs (OFCCP) Director Jenny Yang discussed what the agency is planning for fiscal year (FY) 2023 to participants in the Institute for Workplace Equality’s virtual fall conference. Director Yang opened by discussing the just-concluded U.S. Supreme Court’s oral argument in the UNCand Harvardcases over affirmative action in college admissions. Director Yang believes there is a lot of misunderstanding about what affirmative action means, especially in the employment context, as employment decisions must be made in a nondiscriminatory manner. The goal of affirmative action programs (AAPs) is to serve as a metric to determine where there might be barriers.
Director Yang also stated:
- A new Corporate Scheduling Announcement List (CSAL) will be issued soon under the agency’s new methodology, which will touch more contractors than the last CSAL that was issued.
- Contractors with three or more audits are being coordinated within the agency.
- Over 60% of parent companies are registered on the Contractor Portal, while 50% of establishments are registered.
- The commerce secretary is looking to double the number of women in construction in next two years using the OFCCP to ensure compliance.
- The agency has hired 100 new staff members and is planning to increase their training.
- Proposed new regulations will focus on companywide, not establishment-wide, data.
