Federal agencies take action on artificial intelligence

With the arrival of ChatGPT last year and the release of similar products throughout this winter and spring, the Equal Employment Opportunity Commission (EEOC) and other federal agencies are intensely focused on artificial intelligence (AI). Recently, the EEOC and other agencies held a press conference on AI and vowed to use existing law to combat AI-related harms. Additionally, the EEOC issued new subregulatory guidance for employers using AI in hiring. Overall, the Biden administration is working hard to show the public it’s paying attention to the technology and that AI isn’t outside the reach of laws already in existence.

Joint statement on AI

On April 25, 2023, leadership from the EEOC, the Department of Justice (DOJ), the Consumer Financial Protection Bureau (CFPB), and the Federal Trade Commission (FTC) held a joint press conference on AI. Agency leaders said they are prepared to use their authority under existing laws such as the Fair Housing Act and the Federal Trade Commission Act to protect against harms generated by AI.
