Agency issues RFI for EO 13950

On October 21, the U.S. Department of Labor’s (DOL) Office of Federal Contract Compliance Programs (OFCCP) issued its request for information (RFI) required by President Donald Trump’s Executive Order (EO) 13950 on race and sex stereotyping and scapegoating.

The RFI, which was published in the Federal Register on Thursday, October 22, asks federal contractors, federal subcontractors, and employees of federal contractors and subcontractors to submit comments, information, and materials “concerning workplace trainings involving prohibited race and sex stereotyping or scapegoating” by December 1, 2020. The agency plans to use the responses to “develop useful compliance assistance materials and effective enforcement programs, with the important objective of eliminating race and sex stereotyping and scapegoating.” OFCCP specifically stated that it “welcomes all forms of media and data that have in recent years been used, or that may soon be used, in both voluntary and mandatory training, workshops or similar programming.” The agency asks that materials that are confidential or contain trade secrets not be submitted because the materials submitted may be subject to public disclosure.
