NLRB declares war on Corporate America over noncompetes

May 30, 2023, won’t exactly be a day that goes down in infamy, but corporate America is likely to consider it so. The National Labor Relations Board’s (NLRB) General Counsel (GC) declared on that date that all agency offices across the country (including Texas) should be on high alert to sue over noncompete agreements prohibiting an employee from working for a competitor if they leave employment. The declaration of war was made in an internal agency memorandum (23-08) issued to all regional NLRB offices.
