Among the many overly specific requirements of California employment law, few are more idiosyncratic than the obligation in state wage orders to provide suitable seating for all employees when using the seats doesn’t interfere with the performance of their duties. We have long wondered how the rules would be enforced and who would enforce them. Recently, the California Court of Appeal provided some answers to both questions.
