Atlanta Opera: NLRB faces independent contractor music once more

On June 13, 2023, the National Labor Relations Board (NLRB) released a decision, referred to as Atlanta Opera Inc., that marks a shift in the applicable test for whether a worker qualifies as an independent contractor under the National Labor Relations Act (NLRA). The decision may create an additional hurdle for employers to prove workers are independent contractors who lack NLRA protections and serves as another reminder of a complicated yet crucial journey you should pay attention to when classifying your workers.
